Subject: Re: Lizenz nötig für wmv content auf Firmenhomepage ?

Thanks for the swift reply.

Here's the 'problem' got:

I read the informations at
http://www.microsoft.com/windows/windowsmedia/licensing/musicorvideoservices.aspx
but they didn't slove my problem/question. I don't need a streaming server or something like it, I don't want to use drm in any way and I don't intent to deliver/distribute an encoder or decoder for the material in any way.

my problem/question:
When I integrate wmv material (I own the copyright of the material) created with the Windows Media Encoder 9 into a small business homepage (one-man firm) do I have to pay any license fees to Microsoft or anybody else?

I read the EULA that comes with the Windows Media Encoder 9, which also didn't help.

Since I also read the 'Terms of Use' at the bottom of http://www.microsoft.com/windows/windowsmedia/9series/encoder/faq.aspx
which mention:

"PERSONAL AND NON-COMMERCIAL USE LIMITATION.

Unless otherwise specified, the Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services. "

I'm not sure if I'm allowed to put the material I encoded on a small business homepage or not without license fees.

Would be nice if you could give me a short reply.

Thanks in advance

....

Aufgrund dem hier:

und da ich sonst in den EULAs nix finde würde ich sagen: Ja großes Grinsen

hab mich auch mal umgeguckt wie das mit mp4(avc+aac) Material ist:

Zitat:

- Where End User pays for AVC Video
- Title-by-Title - 12 minutes or less = no royalty; >12 minutes in length = lower of (a) 2% or (b) $0.02 per title.

- Subscription (not limited by title) – 100,000 or fewer subscribers/yr = no royalty; > 100,000 to 250,000 subscribers/yr = $25,000; >250,000 to 500,000 subscribers/yr = $50,000; >500,000 to 1M subscribers/yr = $75,000; >1M subscribers/yr = $100,000

- Where remuneration is from other sources
- Free Television - (a) one-time $2,500 per transmission encoder or (b) annual fee starting at $2,500 for > 100,000 HH rising to maximum $10,000 for > 1,000,000 HH
- Free Internet Broadcast (not title-by-title, not subscription) – no royalty during first term (through 2010; not greater than free television thereafter)
- Enterprise cap: $3.5M/yr 2006-07, $4.25M/yr 2008-09, $5M/yr 2010
- Royalties begin January 1, 2006

source: page 9 of http://www.mpegla.com/avc/avcweb.ppt

So this would mean since the first term is from August 1, 2002 to December 31, 2010 Free Internet Broadcast of avc material should be free. großes Grinsen

Zitat:
Are there use fees for MPEG-4 Audio?
No. License fees are due on the sale of encoders and/or decoders only. There are no patent license fees due on the distribution of bit-stream encoded in an MPEG-4 Audio format, whether such bit-streams are broadcast, streamed over a network, or provided on physical media.

source: http://www.vialicensing.com/products/mpeg4audio/MPEG-4_Audio_FAQ.html#Q6

Zitat:
The Applet pricing is as follows:

$299 - Encoding software, $1.50 per 1000 times the Applet is used to
view video on your site (sometimes called "impressions")
$449 - includes 100,000 impressions, then $1.50 per 1,000 after that
$999 - includes 500,000 impressions, then $1.50 per thousand that
